Bel Canto Bel Canto is a book full of complex characters, who are slowly unraveled throughout the novel. At the beginning of the novel, the characters are caught up in daily struggles for fame, for money, for power. But once captivity removes these struggles, people gravitate toward art and culture. Yet the transformation of Gen Watanabe, from a gifted individual into a man blind by love, could be considered immoral. He starts off as a very capable and sensible young man and in the end transforms into a foolish lovesick boy who gives in to his passions and forgets to think about the current situation. Dream In my dream, I saw my stepmom talking to a group of men. This group of men looked like they were part of a bike gang, and they all had either a knife or a gun on them. The group of men had scary tattoos all over them, leather vests, and distressed jeans on with boots. The men took off and were headed to an apartment complex in search of someone. They didn’t knock on any doors or try to break into a specific apartment; they were just walking around looking for someone outside the apartment buildings. English Legal System UK Civil Legal Process

Question: To be acceptable to ordinary people, I believe [the] legal process in litigation must be designed to encourage, first, settlement by agreement; secondly, open and speedy trial if agreement is not forthcoming. In other words. Justice, not truth is its purpose. It is against criteria of justice and fairness that the system must be assessed. (Lord Scarman) Critically assess the UKs civil legal process. Answer: English Legal System The legal system of every country promises justice to be delivered accurately and quickly. Every person who has suffered physically, economically or mentally approaches the Court of law in its country that guarantees the sufferer or the injured a promise of redressal of his sufferings. As the citizen of the country believes in its justice system and the rule of law, they refrain from taking the law into their hands and believe that justice will be delivered to them some day from the Courts following the adequate rule of law. Therefore, the judicial system of every country has the responsibility to assure inexpensive and quick ways to deliver justice to the citizen of its country without losing the real essence of justice, which includes fairness, unbiased outlook and equality before the law. Thus, the judicial system in the United Kingdom encourages settlement between parties by agreement and speedy trial in case settlement by agreement is not possible. Many disputes that are heard before the Courts get settled before the Courts can believe its final judgement and many disputes are settled between parties before the disputes even come before the Courts. Therefore, the Courts are rapidly encouraging settlement by agreement, as its a faster and a more efficient way of dispute resolution. The Courts go ahead also to include penalties for parties who are not willing to readily follow the said approach of dispute resolution by making them liable for costs of the proceedings which would be allocated to the other party in case of settlement by agreement. Settlement by agreement is an agreement to bring to an end any dispute between two parties by mutual consent following the principle of good faith. The same is an amicable mode of resolving disputes and ending the litigation process between parties or preventing the same. It is become a part of public policy in the United Kingdom to encourage settlement by agreement. In the judgement of the case M. H. Detrick Co v Century Indem Co 299 Ill. App 3d 620 the Court stated that Courts will encourage settlement by agreement and the same will be given full effect. Settlement of any dispute by agreement is permitted before the initiation of court proceedings and during the court proceeding before the courts judgement. Usually, the format of these agreements is in the form of a Consent Order that is in writing which can be enforced if required. In case, of a settlement by agreement, the Consent Form take the place of a Courts Judgement which can be enforced and executed by either f the parties and which includes the order as to which party is liable to bear the costs. Some parties adopt the Tomlin order to settle their disputes, which includes consent order along with an attached schedule to it. The primary feature of Tomlin order is that it permits the parties to include such terms in the order, which even the Court, is not authorised to allow. The most significant reform in settlement by agreements is the provision of Part 36 offer in Civil Procedure regulations in the United Kingdom. The Part 35 offer in the United Kingdom deals with rules that govern the manner in which Courts settle disputes by agreements. It is open to both the parties to a dispute to make a Part 36 offer. If an offer under this section is made by the defendant and the claimant refuses to accept the same, and then claimant will be liable to pay a portion of defendants cost if the sum that is awarded by the court in the final judgement less than what the defendant offered to pay. The same principle will apply in reverse. However, the same will be awarded only when certain formalities as to the said offer is fulfilled. One such formality is that the offer should be open for the other partys acceptance for at least 21 days. It is in the parties favour to make a tempting offer to another party for settlement of disputes and avoid inexpensive litigation. Ho wever, offers made with terms, which are not satisfactory, are allowed to be ignored. Every party before it decides to file a suit in the Court hires an attorney. Therefore, it becomes the duty of the attorney to advice its client on the availability of the option to settle by agreement and assure their clients that it is readily encouraged and accepted by Courts as a means to solve disputes. One primary advantage of this mode of dispute resolution is that the process to attain justice is speedy and inexpensive which every common person in the country is convinced to follow. However, when the parties to a dispute are not ready to accept the settlement by agreement approach to solving disputes, the second option available before the Courts to deliver adequate and quick justice is a speedy trial of the dispute. Many a time, a person may take law in his own hands committing crimes to punish someone after suffering from the said person. However, if the individual is convinced that the regular system in the country can provide him a better and a quicker means to punish his offender, he will opt for the judicial way to punish his offender that will in return eliminate crimes that occur to punish wrongdoers. Therefore, speedy litigation is a key to this problem. On October 1, 2015, the Courts in the United Kingdom came up with a scheme called one-year litigation target. This scheme was enforced to encourage quick and speedy trials. This scheme proposed to end or conclude a case within ten months from the date the case was brought before the court. In case, a dispute between parties cannot be settled by agreement, the Court will adopt the principles of the said scheme to conclude quickly any dispute brought before it. Judgement in this scheme is said to be delivered within six weeks after the trial is completed. For the citizen of the country to adopt the legal way to fight every dispute amongst them, they need to respect the judicial system of the country, which is only possible when the same is favourable and quick. Thus, settlement of disputes by agreement and a speedy trial in case agreement settlement is not materialised will only increase the respect of judiciary in the eye of a common person. We lived like this for nine years and to be honest I felt bad for my dad it was like he kept drowning in the endless deepness of the pool with no possible way up. But despite every hardship he put us through he was everything in my eyes. When he was incarcerated he my world was shredded to pieces. I was the little girl drowning in the deepness of the water, that couldn’t seem to find her way back up. I started doing horribly in school; I went from a straight A student to a student who sat in the back of the classroom to staring off into space. I didn’t care about school, and I felt that I had no reason to do well in school. I wanted to punish my dad for not being there for me, and show him that I needed him. I started acting up at home because I thought it would bring my dad back up from the dark deep water, but I was only drowning my mother and I deeper into the water. One day I received a letter from my dad, it was the first one ever and he wrote it because he owed me an explanation. He explained to me that he didn’t go to college of finish high school because he was rebellious and just wanted to have fun. He said it was the biggest regret in his life and if I wanted to have to support my family in the future the way he had to then to continue on the path I was headed. But I still had time to come up from the deep dark water and revive myself so I can open my eyes to the beautiful sunshine. I didn’t want to have to live like that in the future. I would never want my kids to drown in the deepness of water but to instead float on top of the water. I realized my dad was given an opportunity to come up from the water and revive himself to. He was incarcerated to realize that what he was doing was wrong and improve his life. He learned a lot while he was in there and came out a changed man. He had to make the mistake of jumping into the deep end and drowning before he could realize that he had to begin in the shallow first to become a great swimmer.

At the Turn of a Dime

The only thing I could think of as I stood at the end of the vault runway were my sweaty feet. As a nervous habit, I fidgeted, making it obvious that I felt a little uneasy. It seemed silly that I had trained so many demanding hours to perform this one vault skill, and that I was still anxious. Once I saluted the judge indicating I was ready, I thrust all negative thoughts to the back of my mind and launched into an aggressive sprint hurtling towards the vault. The next two seconds consisted of me holding my breath as I pushed off the vault table and completed a full 360 degree flip until I landed on my feet almost with ease. Immediately, I felt joy swell inside of me as I knew I had just performed the best vault I had ever done in my entire gymnastics career. As I walked back to the end of the running strip, my teammates clapped me on the back giving encouragement and support. The exhilaration I had felt after my first vault supplied me with adrenaline. When I began my second vault, I pounded down the runway with new energy and power. However, once I was in the process of flipping, I knew something was wrong. I ended up landing short, causing my ligaments to jam and tear within my left ankle. The audience that was once before bubbling with exuberance, instantly became deflated and silent as I lay there motionless on the mat. But I didn’t cry, I just gritted my teeth. I didn’t scream, I just shook my head. And I didn’t get up, I just sat there clutching my ankle with one hand while resting my head on the other, face down. Sharp pains exploded through my ankle and I could feel everyone’s stares burning a hole right through me. Needless to say, I probably scared the pants off my parents. From success to disappointment, I had learned that life could change on a dime. After this incident, I dedicated my time to my recovery and I began to understand that in the real world, people experience ups and downs too. Whether it may be about losing a job or going through a heartbreak, it’s the recuperation process that helps strengthen our character. While I was frustrated at first with my injury, I learned to cope with it and began to feel optimistic about how it could help me in the long run. I was determined to not let this slow me down, but rather build it up as a motivation and an extra push. Gymnastics has been my building blocks for life that I will continue to carry with me into the future. All the countless hours toiling away in the gym have given me the basic fundamentals for achieving accomplishments in life. I have been able to utilize these skills that I have learned, such as determination, perseverance, and time management, and use them to my advantage in school and work experiences. Getting home at a late hour every night has forced me to efficiently get my homework done since I know I don’t have a minute to spare, and when I help my parents in their flower shop, I make good use of my time. The principle of time management has been drilled into my head after so many years of steadily keeping my busy schedule on track. I have attained the qualities of patience, dedication, and focus patience in the way that I can accept the drawbacks along the way to achieve something greater, dedication in the way my willingness can persevere challenges without giving up, and focus in the way I can accomplish anything by being mentally tough. I intend to employ these attributes that I have gained from gymnastics as I begin my quest into the real world.

Femininity in Homer’s Iliad In Homer’s Iliad, predominant feminine presence inspires the events of the poem and the destinies of the men involved. This feminine presence is not a product of the actions and decisions of the women in the poem, but rather a conceptual, creative feminine force without which the poem and even human life would not exist. Homer personifies this presence in nature and maintains it through the voice of the Muse, his inspiration. There is a deeper essence of a feminine presence in the poem, however, which lies in the characteristics of life itself. It is the woman who gives birth to the heroes and therefore she is the first to bring her child to life and to put him on the road to death. This biological phenomenon might seem superficially irrelevant to the fears and concerns of the masculine heroes who are most concerned with death, destiny and honor, the principle themes of the Iliad. These are of great importance to these heroes because these aspects of life will determine whethe r or not the world will remember them. Furthermore, as fame is their only path to immortality, the desire for fame after death motivates them to live honorably. It is the feminine role in nature that introduces the men to the life of the hero which instills this longing to be remembered after death, and it is, therefore, the feminine role in nature that gives purpose to human life. Homer acknowledges this effect and uses poetic devices to maintain a powerful presence of femininity throughout the poem. The feminine presence in the Iliad carries the poem like a pregnant woman carries a fetus in its final stages in the womb. Without a decent parentage and honorable descendents, a man’s fame will not survive his death. Men do not have the power to ensure that they will have children and grandchildren to continue their lineage; it is the woman who carries the child in her womb. A man can never be sure if his child is legitimately from his or another man’s blood line. This knowledge is a power that nature gave the woman, a power that no man can ever control. Native American Vision Quest Essay

Vision Quest: A vision quest is a rite of passage in Native American cultures and more specifically the Oji-Cree. It was undertaken by a person when they reached puberty. The vision quest comprised of going to the wild for about ten days to fast. This took place either at the top of a hill or if need be a platform built in a tree. During the vision it is expected that at least one or more spirits would take pity on the individual and become his or her protector in the ordeal as well as a source of spiritual power for life. The carrying out of the vision quest was normally for males only in some Native American cultures; however for the Oji-Cree both males and females participated in this quest. During the vision fast power could be obtained and subsequently enhanced by fasting. During the course of the vision quest an individual would also receive his or her secret name from their spirit protector. The vision quest constituted for half of the spiritual rituals the Oji-Cree would undertake the other half being the shaking tent ceremony. The historical significance of this ritual was it was undertaken by individuals to provide power for themselves. Power was important as the Oji-Cree believed that power was inherent in every living thing and object, thus making it a important part of their way of life. Torah: The torah or also known as the law are the first five books of the Bible. It contains the essence of Judaism as well as ethical teachings and basic guidance. The Torah also contains the Ten Commandments which were given to the Hebrews by the Prophet Moses. The books that make up the Torah are Genesis (creation), Exodus (departure), Leviticus, Numbers and Deuteronomy. Although sometimes it may contain The Prophets and usually the Psalms and other writings however some Hebrew scholars omit the Psalms and other writings. In the Christian faith the Torah is known as the Old Testament. The Torah provides modern day Jews with a explanation of what occurred in the time of the biblical Hebrews, events such as the conquest of Canaan and the exploration into the promised land are written in the Torah. The Torah is an integral part of the Jewish faith and is a corner stone in the teaching and spreading of the Jewish faith. Complimentary religious texts include the Mishnah and Talmud. In addition to providing the Jewish faith with guidelines and commandments the Torah also allowed for the academic interpretation of Hebrew teachings. These studies and interpretations were carried out by men called Rabbis which means teacher or my master. The Torah had increased significance during the Greek occupation of Judah as it became the foundation for the law of Judah in an attempt to preserve Jewish religion. The Torah also saw translation by the hands of the Greeks later on as the Greeks were fascinated by Judaism. This translation was named the Septuagint (in Greek it was Septuaginta) which meant seventy, seventy being the number of translators needed. Qur’an: The Qur’an is the central religious text of the Muslim faith. Islamic adherents believe that the Qur’an is the verbatim word of God. It`s origins start when the Prophet of the Muslim faith Mohammed was approached by the angel Gabriel during the month of Ramadan on Mount Hira. This was a repeat experience as it happened in later points in his life. In light of the fact that he was illiterate, he recited the teachings he had heard from Gabriel and by extension God to his followers who wrote them down. Similar to the Torah and the Bible the Qur’an was a written copy of oral tradition. However while the Torah and the Bible had multiple authors, Mohammed was the sole individual who dictated the Qur’an. In Arabic the word Qur’an means reading or recitation and it is generally believed that the Qur’an was to be the final message of God to humanity, making Mohammed merely the vessel from which this was sent. The Qur’an is tremendously significant to Muslims as in their eyes it is more than just a Holy Book, they see it as divine thought in written form consisting of the very mind and essence of God being communicated through Mohammed to humanity. It is a similar concept to the Christian concept of Logos, which is the Word of God being incarnate in Jesus Christ. The Muslim equivalent of Logos would be the Qur’an. Like the Christian`s Bible and the Hebrews Torah the Qur’an provides the framework of the Muslim faith as well is integral to the carrying out of the religions tenants. The Qur’an has influenced many events across history and can be considered the finest piece of literature in the Arabic Language. Sunni: Sunni is one of the sects of Islam, the other being Shi’a . Sunni is also the majority sect in Islam. The origins of the Sunni sect are intertwined with the Shi’as’ in an event known as the Shi’sm. The origins of Shi’sm derive from the cousin and son-in-law of the Prophet Mohammed named Ali. Most historians believed that Ali was the first male to embrace the Prophet’s message of Islam. His adherents also believed that he was he rightful successor of the Prophet and that he had been chosen by the prophet as the political and spiritual leader of Islam. The Sunnis were the faction who did not believe that the Prophet had selected Ali to succeed him. This clash of beliefs caused a schism with Islam and saw the creation of Sunnis and Shi’ites. While this schism was centuries ago it has significant implications in the modern day setting especially in the Middle east. In Iraq a part of the current warfare which is occurring is between the two groups. While Sunnis are a majority in most of the Muslim world, Iraq is predominantly Shi’a. The President of Iraq Saddam Hussein belonged to the Sunni faction and represented the minority rule over the majority in the country. While the Sunni faction differs from the Shi’a on terms of succession and other doctrine both groups agree that Allah is one and Mohammed is his last prophet. Regarding Islam, Sunni is often referred as the orthodox version of the religion. Bhagavad Gita: The Bhagavad Gita is a 700 hundred verse Hindu scripture. It is a veda or a old sacred book of Hinduism. The Bhagavad Gita is an epic poem describing classical Hinduism and was composed approximately near the end of the pre-classical age and beginning of the classical age of Hinduism. Its writing form is as a narrative of a great battle and is a section of a larger work known as Mahabharata, which was created much earlier in time. The premise of the Bhagavad Gita is :Prior to the battle a great warrior, Ajuna hesitates to fight. His charioteer, Krishna teaches him that it is his purpose and destiny to fight. Ajuna’s charioteer turns out to be an incarnation of the god Vishnu or in Hindu culture an avatar. The Bhagavad Gita is a compilation of centuries of developing worship, mediation and thought. The text consists of developed concepts of classical Hinduism touching on several points such as the gods Vishnu and Shiva and the concepts of karma, dharma, reincarnation and cases. The dimensions of the Bhagavad Gita are 18 chapters and 700 verses found in the Mahabharata. The Bhagavad Gita was spiritually important as it served as a source of spiritual knowledge as well as serves to reveal the purpose and goal of human existence. Master K’ung: Master K’ung or more commonly known as Confucius is one of the most important Chinese philosophers. He is traditionally hailed as the father of philosophical school of Confucianism. In addition to his capacity as a philosopher Master K’ung was also traditionally known as a was a thinker, political figure and educator. Master k’ung was said to have lived from 551-479 B.  C, his teachings were transferred orally by his students, emphasizing a way of life called ren. Ren was defined as right living and was achieved through li or ethical propriety, good manners and traditional ritualistic practices. According to his teachings family was seen as the central vehicle to cultivate these attributes. Master K’ung’s thoughts became available in a book known as the Analects. Master K’ung’s journey consisted of him leaving his life behind and wandering with a band of disciples until he found internal peace. While claims are unlikely, Master K’ung is attributed with works known as the Five Classics. These classics consist of the Shu Ching or Classic of History (writings and speeches from ancient Chinese rulers), the Shih Ching or Classic of Poetry (300 poems and songs), the I Ching or Classic of Changes (the description of a divinatory system), the Ch’un Ch’iu or Spring and Autumn Annal (a history of the state of Lu from 722 to 484 BC) and the Li Ching or Classic of Rites (a group of three books on the Li the rites of propriety. In addition there was also a now lost sixth book called the Yueh Ching or Classic of Music. Maste K’ung had a tremendous legacy which effected the world, as millions around the world would apply his wisdom and thoughts even in this day and age.
