Ever since tobacco and smoking has been invented and become popular amongst people of all ages and backgrounds, numerous studies and methods have been dedicated to studying how one can actually quit smoking for good. One may ask why start smoking if quitting is the main aim. The answer is simple. People resort to it in times of crises or due to peer pressure, only later realizing its harmful consequences for health. Upon interview, a US based Surgeon pointed out the fact that one of the most important ways of enhancing the quality and number of years of oneââ¬â¢s life is to quit smoking. To quit smoking gradually, one has to replace it with nicotine patches completely and then gradually decrease the content of nicotine through thee patches. This makes the body gradually used to getting rid of nicotine addiction. However, a qualified and specialized doctor needs to be consulted before using such nicotine products and they are not be bought or used without a prescription. (Anda, Williamson, Escobedo, 1990) Counseling and rehabilitation programs: through proper group therapy or individual sessions with experts, people become aware of their weak and strong points and how to overcome the weak ones. According to Paddock, advice from others helps to raise self awareness and makes it easy for one to recognize when and what his weak moments are. Support from your peer groups is also important in order to prevent any relapse that might occur and helps you become focused on your o bjective i.e., to quit smoking. Daily Struggles for Fame, Money, and Power in the Book Bel...
Bel Canto Bel Canto is a book full of complex characters, who are slowly unraveled throughout the novel. At the beginning of the novel, the characters are caught up in daily struggles for fame, for money, for power. But once captivity removes these struggles, people gravitate toward art and culture. Yet the transformation of Gen Watanabe, from a gifted individual into a man blind by love, could be considered immoral. He starts off as a very capable and sensible young man and in the end transforms into a foolish lovesick boy who gives in to his passions and forgets to think about the current situation. Despite being just a translator who possessed knowledge of several difficult languages, Gen was also a capable worker. Mr. Hosokawa praised him for doing things that were even asked of him. Mr. Hosokawa even commented that ââ¬Å"When there was nothing that needed translating, Gen simply seemed to take care of things before anyone knew they needed taking care of.â⬠Mr. Hosokawa was not the only one who praised Gen. Everyone else admired him likewise. The Generals, along with all the hostages, were surprised by his capabilities. General Benjamin even asked him ââ¬Å"How did you get to be so smart?â⬠Gen was complimented more than once that was probably nothing that he couldnââ¬â¢t do. Analysis Of My Dream - 1056 Words
Dream In my dream, I saw my stepmom talking to a group of men. This group of men looked like they were part of a bike gang, and they all had either a knife or a gun on them. The group of men had scary tattoos all over them, leather vests, and distressed jeans on with boots. The men took off and were headed to an apartment complex in search of someone. They didnââ¬â¢t knock on any doors or try to break into a specific apartment; they were just walking around looking for someone outside the apartment buildings. When they found who they were looking for, they started running and shooting towards that person. It was my father. At this point in my dream, I started screaming and crying, but I wasnââ¬â¢t actually in my dream. At that point, I knew that the only two characters that I had to focus on were on her dad and her stepmother. When I ask the dreamer to tell me about her stepmom, she replied by saying that she was an awful person and that they never got along. Then, when I ask her to tell me about her dad, she went on to tell me that her dad and her, have always had a close bond, and that she feels until this day that she has to protect her dad from her stepmom, as she has done some pretty bad stuff to her dad during and after their marriage. Many people have this idea that they should rot in jail for the pain they have caused others and that they deserve this type of treatment. In some instances I agree with it to a certain extent but on the other hand it is useful to think about what causes these individuals to lead a life of crime in the first place and what could be done to help these people become better while locked up. Often times the same behavior that got these men and women into prison in the first place is continued while incarcerated. I think this is partly due to the fact that prison is better at punishing people rather than helping to rehabilitate them. English Legal System UK Civil Legal Process
Question: To be acceptable to ordinary people, I believe [the] legal process in litigation must be designed to encourage, first, settlement by agreement; secondly, open and speedy trial if agreement is not forthcoming. In other words. Justice, not truth is its purpose. It is against criteria of justice and fairness that the system must be assessed. (Lord Scarman) Critically assess the UKs civil legal process. Answer: English Legal System The legal system of every country promises justice to be delivered accurately and quickly. Every person who has suffered physically, economically or mentally approaches the Court of law in its country that guarantees the sufferer or the injured a promise of redressal of his sufferings. As the citizen of the country believes in its justice system and the rule of law, they refrain from taking the law into their hands and believe that justice will be delivered to them some day from the Courts following the adequate rule of law. Therefore, the judicial system of every country has the responsibility to assure inexpensive and quick ways to deliver justice to the citizen of its country without losing the real essence of justice, which includes fairness, unbiased outlook and equality before the law. Thus, the judicial system in the United Kingdom encourages settlement between parties by agreement and speedy trial in case settlement by agreement is not possible. Many disputes that are heard before the Courts get settled before the Courts can believe its final judgement and many disputes are settled between parties before the disputes even come before the Courts. Therefore, the Courts are rapidly encouraging settlement by agreement, as its a faster and a more efficient way of dispute resolution. The Courts go ahead also to include penalties for parties who are not willing to readily follow the said approach of dispute resolution by making them liable for costs of the proceedings which would be allocated to the other party in case of settlement by agreement. Settlement by agreement is an agreement to bring to an end any dispute between two parties by mutual consent following the principle of good faith. The same is an amicable mode of resolving disputes and ending the litigation process between parties or preventing the same. It is become a part of public policy in the United Kingdom to encourage settlement by agreement. In the judgement of the case M. H. Detrick Co v Century Indem Co 299 Ill. App 3d 620 the Court stated that Courts will encourage settlement by agreement and the same will be given full effect. Settlement of any dispute by agreement is permitted before the initiation of court proceedings and during the court proceeding before the courts judgement. Usually, the format of these agreements is in the form of a Consent Order that is in writing which can be enforced if required. In case, of a settlement by agreement, the Consent Form take the place of a Courts Judgement which can be enforced and executed by either f the parties and which includes the order as to which party is liable to bear the costs. Some parties adopt the Tomlin order to settle their disputes, which includes consent order along with an attached schedule to it. The primary feature of Tomlin order is that it permits the parties to include such terms in the order, which even the Court, is not authorised to allow. The most significant reform in settlement by agreements is the provision of Part 36 offer in Civil Procedure regulations in the United Kingdom. The Part 35 offer in the United Kingdom deals with rules that govern the manner in which Courts settle disputes by agreements. It is open to both the parties to a dispute to make a Part 36 offer. If an offer under this section is made by the defendant and the claimant refuses to accept the same, and then claimant will be liable to pay a portion of defendants cost if the sum that is awarded by the court in the final judgement less than what the defendant offered to pay. The same principle will apply in reverse. However, the same will be awarded only when certain formalities as to the said offer is fulfilled. One such formality is that the offer should be open for the other partys acceptance for at least 21 days. It is in the parties favour to make a tempting offer to another party for settlement of disputes and avoid inexpensive litigation. Ho wever, offers made with terms, which are not satisfactory, are allowed to be ignored. Every party before it decides to file a suit in the Court hires an attorney. Therefore, it becomes the duty of the attorney to advice its client on the availability of the option to settle by agreement and assure their clients that it is readily encouraged and accepted by Courts as a means to solve disputes. One primary advantage of this mode of dispute resolution is that the process to attain justice is speedy and inexpensive which every common person in the country is convinced to follow. However, when the parties to a dispute are not ready to accept the settlement by agreement approach to solving disputes, the second option available before the Courts to deliver adequate and quick justice is a speedy trial of the dispute. Many a time, a person may take law in his own hands committing crimes to punish someone after suffering from the said person. However, if the individual is convinced that the regular system in the country can provide him a better and a quicker means to punish his offender, he will opt for the judicial way to punish his offender that will in return eliminate crimes that occur to punish wrongdoers. Therefore, speedy litigation is a key to this problem. On October 1, 2015, the Courts in the United Kingdom came up with a scheme called one-year litigation target. This scheme was enforced to encourage quick and speedy trials. This scheme proposed to end or conclude a case within ten months from the date the case was brought before the court. In case, a dispute between parties cannot be settled by agreement, the Court will adopt the principles of the said scheme to conclude quickly any dispute brought before it. Judgement in this scheme is said to be delivered within six weeks after the trial is completed. For the citizen of the country to adopt the legal way to fight every dispute amongst them, they need to respect the judicial system of the country, which is only possible when the same is favourable and quick. Thus, settlement of disputes by agreement and a speedy trial in case agreement settlement is not materialised will only increase the respect of judiciary in the eye of a common person. Although he knew he would drown every time he had to keep trying it until he realized he needed to begin in the shallow to become a great swimmer. When I was about twelve years old my father was incarcerated. At thirty-six years old he was still trying to jump into the deep end without learning how to swim first. Instead of finishing high school and going to college he took the easy path and became a mechanic. I was the little girl drowning in the deepness of the water, that couldnââ¬â¢t seem to find her way back up. I started doing horribly in school; I went from a straight A student to a student who sat in the back of the classroom to staring off into space. I didnââ¬â¢t care about school, and I felt that I had no reason to do well in school. I wanted to punish my dad for not being there for me, and show him that I needed him. I started acting up at home because I thought it would bring my dad back up from the dark deep water, but I was only drowning my mother and I deeper into the water. One day I received a letter from my dad, it was the first one ever and he wrote it because he owed me an explanation. He explained to me that he didnââ¬â¢t go to college of finish high school because he was rebellious and just wanted to have fun. He said it was the biggest regret in his life and if I wanted to have to support my family in the future the way he had to then to continue on the path I was headed. But I still had time to come up from the deep dark water and revive myself so I can open my eyes to the beautiful sunshine. I didnââ¬â¢t want to have to live like that in the future. I would never want my kids to drown in the deepness of water but to instead float on top of the water. I realized my dad was given an opportunity to come up from the water and revive himself to. He was incarcerated to realize that what he was doing was wrong and improve his life. He learned a lot while he was in there and came out a changed man. He had to make the mistake of jumping into the deep end and drowning before he could realize that he had to begin in the shallow first to become a great swimmer.
